The controller of your personal data is URBANITAE REAL ESTATE PLATFORM S. L. (hereinafter, the “Company”, “Urbanitae”, a Crowdfunding Platform with registered office in Madrid, Calle Castelló, nº 23, 1st Floor, VAT number B-88393962 and registered in the Mercantile Registry of Madrid, in Volume 37697, Folio 180, 1st entry.

For what purpose do we process your personal data?

Personal data will be processed for the purpose of managing your participation in the crowdfunding project, either as an investor or as a promoter. Given the impossibility of carrying out this management without the mentioned processing, to request the cancellation of your data, it is necessary that you have previously settled your participation in the project for which you want to cancel the data.

Likewise, your data will be processed for sending advertising for other services offered by Urbanitae, such as the direct purchase of homes built for the projects we finance through the platform.

Urbanitae expressly prohibits persons under 18 years of age from participating in projects, both as an investor and as a promoter. Therefore, if you are under 18, please do not continue with the process or use our services. The User will be responsible, in any case, for the truthfulness of the data provided, with Urbanitae reserving the right to exclude from the registered services any User who has provided false data, without prejudice to other actions that may be applicable by law.

Similarly, if you have filled in your data in the “Contact” section, Urbanitae will process your data solely to handle your request and to contact you in response to it. The interested party who wishes to contact Urbanitae through the Website will fill out a form for this purpose in which they will include their personal data, as well as the message they wish to send. Urbanitae will process your personal data for the sole purpose of managing and responding to the information request received. The processing that Urbanitae carries out with said personal data is based on the implicit consent of the interested party by providing their personal data to Urbanitae in order to obtain the information they need.

Furthermore, if you consent, Urbanitae will use personal data to develop and improve our services and products, as well as to send you information tailored to your profile about new opportunities published on the Urbanitae website or other companies that are part of the same business group as Urbanitae and information on complementary products and services to those offered on the website, both our own and from third parties.

If you consent, Urbanitae will use anonymized personal data for statistical analysis and market research.

To whom do we transfer your data?

Urbanitae has service provider collaborators, such as IT and web maintenance companies, legal services, and administrative agencies that, in the course of providing their services, access personal data of Urbanitae. Urbanitae carries out a meticulous selection and control of these third parties with whom it has signed data protection agreements, where they are obliged to follow a series of obligations regarding data protection.

How do we collect your data?

The personal data processed by Urbanitae has been provided directly by you by completing the forms provided for this purpose.

For how long will we keep your data?

All personal data you provide through the registration form as a potential investor and/or promoter on the website and those added by entities that may participate in data collection will be kept, at least, as long as the investment in which you participate is active.

Legal Basis

The legal basis that legitimizes the processing of the data provided by users through the contact or promoter form, as well as the registration in the application, will be the user's non-express consent. Said non-express consent does not generate a significant impact on the rights of the interested party, and all necessary guarantees are carried out in accordance with the GDPR (art.6.1.f) and the LSSI-CE (art. 21.2).

The communication of personal data is a necessary requirement to manage your participation in crowdfunding projects, so you should provide them. If this is not done, participation cannot take place, so we could not carry out any operation.

Security measures

Urbanitae declares that it has adopted all the necessary security measures to ensure the integrity, security, and preservation of the personal data stored in its systems, in accordance with the provisions of the current regulations on data protection, recognizing and appreciating the importance of the responsible use of this information.

What are your rights when you provide us with your data and how can you exercise them?

The User may exercise their rights of access, rectification, cancellation, opposition, portability, and erasure by writing to Urbanitae, at Urbanitae's registered office at Calle Castelló nº 23, 28001, Madrid. The communication can also be sent by email to the address: contacto@urbanitae.com. In any case, you can always contact the Spanish Data Protection Agency, the supervisory authority on the matter, with an address at Calle Jorge Juan, 6, 28001, Madrid, in order to safeguard your rights.
